Terms of Service

1. Introduction

These Terms of Service govern your use of Trudy's Table, a reservation management platform operated by Trudy's Table Inc. ("we," "us," "our"). By creating an account, booking a table, or otherwise using the platform, you agree to these terms. If you do not agree, please do not use the platform. Where a restaurant owner or manager accepts these terms, they accept them on behalf of the restaurant and confirm that they are authorized to do so. Section 6 is the written agreement that governs how we handle guest personal information on the restaurant's behalf.

2. Accounts

You may create an account using phone-based authentication, which sends a one-time code by text message. You are responsible for keeping access to your phone number secure and for all activity under your account. You must provide accurate information and keep it current. We may suspend or close accounts that breach these terms.

3. Restaurant Accounts

Restaurant owners and managers ("Operators") may create and manage restaurant profiles on the platform. Operators are responsible for the accuracy of their restaurant information, including hours, capacity, and policies. Each restaurant profile is managed independently: staff can only reach the restaurants they have been added to. Access is controlled through roles (owner, admin, staff). Separately, the Admin View, where settings, services, and floor plans are configured, is protected by a restaurant PIN. Anyone who holds that PIN can enter the Admin View regardless of their role, so deciding who receives it is an access decision the Operator owns.

4. Guest Terms

Guests who book through Trudy's Table agree to honour their reservations. When a restaurant requires a card on file, the guest authorizes us to save their payment card securely through Stripe, a PCI DSS compliant payment processor. The card is tokenized and stored. No charge and no authorization hold is placed at the time of booking, and nothing appears on the guest's statement unless a fee is later applied. There is no automatic charge anywhere on the platform. A fee can only be applied afterward, by a signed-in owner or admin taking an explicit action. If the guest arrives, or cancels within the restaurant's policy, the saved card is simply cleared and never charged. Guests can view, change, or cancel a reservation through the link in their confirmation email.

5. Payments and No-Show Fees

Operators subscribe to Trudy's Table on a monthly billing cycle. There is no annual contract, and you can cancel at any time. Access continues until the end of the billing period you have already paid for. Subscription fees are those quoted to you when you subscribe, and we will give reasonable notice before changing them. If a guest does not honour a reservation, the Operator decides what happens to the card on file. There are three outcomes: charge the no-show fee, clear the card without charging it, or clear the card because the guest purchased gift cards worth at least the amount of the fee. The choice belongs to the restaurant and is always made by hand. No-show fees are charged on the restaurant's own Stripe account, not on ours. The restaurant is the merchant of record for that charge: it pays its own Stripe processing fees, receives its own payouts, and is responsible for disputes and chargebacks. Trudy's Table takes no share of a no-show fee. We never store raw card numbers or security codes. We hold only Stripe identifiers, the card brand, and the last four digits.

6. Guest Personal Information

Guest personal information handled through the platform belongs to the restaurant. For that information the Operator is the person responsible under Quebec's Act Respecting the Protection of Personal Information in the Private Sector, and Trudy's Table acts as its service provider. This section is the written mandate required by section 18.3 of that Act, and it applies to every restaurant account. Purpose limitation. We process guest personal information only to provide the services the Operator has asked for, and only on the Operator's instructions. We do not use it for purposes of our own, we do not sell it, and we do not share it for advertising. Confidentiality. We keep guest personal information confidential. The same obligation binds our personnel and anyone acting on our behalf. Security. We protect guest personal information with encryption in transit and at rest, role-based access controls, row-level security in the database, and tenant isolation that keeps each restaurant's records separate from every other restaurant's. Sub-processors. We may engage the service providers named in our Privacy Policy. Each is bound to confidentiality and security obligations equivalent to those in this section, and we remain answerable to the Operator for the work they do on our behalf. Retention and return. We hold guest personal information while the account is active and for as long as we need it to provide the services. On termination, the Operator may ask us to export its data or to delete it, and we will act on that request within the timeline set out in our Privacy Policy. Breach notification. We will notify the Operator promptly of any violation, or attempted violation, of the confidentiality of guest personal information, and give the Operator what it needs to meet its own reporting obligations. Messages to guests. The Operator authorizes us to send messages to its guests on its behalf and under its own name. The Operator confirms that it holds the consent or the business relationship those messages rest on under Canada's anti-spam legislation, and that the guest contact information it provides was collected lawfully. Operator obligations. The Operator is responsible for the accuracy of the information it enters, for the content of any notes its staff record about guests, and for limiting platform access to the people who need it, including anyone it gives the restaurant PIN to.

7. SMS and Email Communications

Some messages are part of the reservation itself and are sent for every booking: confirmation of a new reservation, notice of a change or a cancellation, a request to add a card where the restaurant requires one, and a reminder the evening before. These are transactional service messages, not marketing, and there is no opt-out for them while a reservation is active. Cancelling the reservation ends them. Reminders are controlled by the restaurant rather than by the guest. An Operator can turn reminders off in its settings, and that setting applies to every booking at that restaurant. Where a restaurant sends offer emails, each one carries an unsubscribe link. Using it stops offer emails from that restaurant and leaves the reservation messages above unaffected. There is no separate communication-preferences screen on the platform. To stop reservation messages entirely, cancel the reservation or ask the restaurant to remove your contact information.

8. Privacy

Your use of Trudy's Table is also governed by our Privacy Policy, which sets out what we collect, how we use it, which service providers we rely on, where information is processed, and how to exercise your privacy rights. It is published at trudystable.com/en/privacy.

9. Intellectual Property

All content, features, and functionality of Trudy's Table itself, including the software, text, graphics, logos, and design, are owned by Trudy's Table Inc. and protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from the platform without written permission. Content an Operator uploads, such as its restaurant name, logo, and descriptions, stays the Operator's. By uploading it, the Operator grants us the limited right to display it in the booking and guest-facing surfaces we provide, for as long as the account remains open.

10. Limitation of Liability

Trudy's Table is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including lost bookings or lost revenue. Our total liability for any claim will not exceed the fees you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited under Quebec or Canadian law.

11. Termination

You may close your account at any time. We may suspend or end your access if you breach these terms or act in a way that harms other users or the platform. When access ends, your right to use the platform stops immediately. Before an account closes, or shortly after, an Operator may ask us to export its data or to delete it. We handle those requests as described in our Privacy Policy, and otherwise retain data in line with that policy.

12. Governing Law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of Quebec.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or through the platform, and the date at the top of this page shows when they were last revised. Continuing to use Trudy's Table after a change takes effect means you accept the updated terms.
